BLACK BEAR RV PARK — TERMS & CONDITIONS


UPPER LEVEL / SERENITY RIDGE MOUNTAIN CLUB

  • The upper level is private property and strictly off-limits to all RV Park guests.
  • No access by any means — foot, vehicle, golf cart, bike, or otherwise — without explicit prior written authorization from management.
  • Unauthorized access constitutes trespassing and will result in immediate eviction and permanent ban.

GENERAL RULES

  • By reserving a site, Guest agrees — on behalf of themselves, their minors, and all accompanying guests — to comply with all posted, published, and communicated Park Rules.
  • Use of the campsite is a revocable license only. No property interest or tenancy rights are acquired.
  • All reservation information must be accurate and complete. False information may result in legal action.

MOTORCYCLES

  • Motorcycles may not be started, operated, idled, or ridden anywhere on the property.
  • Motorcycles must arrive and depart by trailer or other non-operating transport only.
  • Violation may result in fines and immediate eviction.

SCHOOLING

  • Children of guests are not eligible for enrollment in or attendance at local schools during their stay.
  • Any attempt to enroll constitutes a material breach and will result in immediate eviction.

OCCUPANCY & STAY LIMITS

  • Maximum stay: 210 days in any twelve-month period.
  • Maximum occupants per site: 8. Additional guests require prior written approval or a separate site rental.
  • Violations may result in additional charges, eviction, or other remedies at management’s discretion.

ANIMALS

  • All animals must be leashed or securely fenced at all times, including within the Guest’s own site.
  • Aggressive animals are strictly prohibited. Management has sole discretion to evaluate and remove any animal.
  • Management may require vaccination records, behavioral assessments, or other documentation at any time.
  • By initialing below, Guest warrants that all registered pets have no history of aggressive behavior.
  • Persistent disruptors or threatening animals must be removed from the property; non-compliance may result in eviction without refund.
  • Certain areas are designated pet-free (dining areas, indoor recreational facilities, and surroundings).
  • All pets must have current vaccinations; proof may be required upon request.

QUIET HOURS

  • Quiet hours: 10:00 PM – 8:00 AM.
  • All fires must be fully extinguished by midnight.

CAMPFIRES

  • Fires must be contained in designated fire rings only.
  • Fires must never be left unattended.
  • Maximum flame height: 2 feet.
  • All fires must be fully extinguished when done.

MAIL & PACKAGES

  • Mail is not accepted at the campground and will be returned to sender.
  • Guests may establish a local PO Box for mail. Amazon, UPS, and FedEx package delivery is permitted.

VEHICLES & PARKING

  • Maximum 2 vehicles per site, parked within the site’s designated boundaries only.
  • No parking on unauthorized sites or areas.
  • Prohibited on premises: unsightly or damaged vehicles, commercial vehicles, ATVs, UTVs, dirt bikes, mopeds, or any excessive-noise motorized vehicle.
  • Operating any motorized vehicle — including golf carts — while impaired is strictly prohibited.
  • Guest consents to towing of any vehicle in violation of park rules, at the owner’s expense.

SAFETY & CONDUCT

  • Conduct that endangers any person — including the Guest — will result in immediate removal and fines.

POND

  • Swimming, ice fishing, and skating are strictly prohibited.
  • Minors must be supervised by a parent or guardian in the pond area at all times.

COMMERCIAL ACTIVITY

  • All commercial activity is strictly prohibited on the premises, including preparation, storage, or execution of any business-related tasks, directly or indirectly.
  • Violation results in immediate expulsion.

LITTERING

  • Zero-tolerance policy. All waste must be disposed of in designated receptacles.
  • Violation results in immediate eviction and a fine determined by management.

SUPERVISION OF MINORS

  • Children under 10 must be under constant adult supervision at all times.
  • All toys and play items must remain within the assigned site. Items found outside may be removed; the campground is not responsible for removed items.
  • Per New York State law, children under 14 must wear a certified helmet when operating or riding a bicycle, in-line skates, skateboard, or scooter. Non-compliance may result in removal from the premises.

ADDITIONAL GUESTS

  • Reservations are valid only for the number of guests specified at booking.
  • Unauthorized additional guests may result in additional charges or cancellation.

SITE LOCK FEE

  • Payment of a site lock fee does not guarantee a specific site. Management reserves the right to refund the fee and reassign Guest to a different site at any time, with or without notice.

DAMAGE TO PROPERTY

  • Guest is solely responsible for all damage caused by themselves, family members, visitors, or pets, whether resulting from negligence, misuse, or intent.
  • Damage costs are measured by restoration or replacement value and are charged as additional site rent.

LOITERING

  • Loitering is prohibited in all common areas, including roads, trash areas, public buildings, and vacant or occupied sites — whether on foot or in a vehicle.
  • Non-compliance results in immediate removal.

HOLD HARMLESS & INDEMNIFICATION

  • Assumption of Risk: Guest and all accompanying parties assume all risks associated with camping and use of campground facilities.
  • Release of Liability: Guest releases the Campground, its owners, officers, employees, and agents from all liability for any injury, loss, damage, or death arising from use of the premises or its facilities.
  • Indemnification: Guest agrees to indemnify and hold harmless the Campground from any and all claims, losses, costs, and attorneys’ fees arising from Guest’s or Guest’s party’s conduct or use of the premises.
  • Personal Property: The Campground is not liable for damage to RVs, vehicles, or personal property caused by weather, wildlife, theft, vandalism, or any other cause.
  • Medical Emergencies: Campground may not have medical facilities on-site. Guest assumes full responsibility for obtaining medical care and releases the Campground from related liability.
  • Non-Compliance: Failure to comply with campground rules may result in termination of stay without refund.

PRICING POLICY

  • Black Bear RV Park may adjust pricing at any time. Notice will be provided prior to the Guest’s next billing cycle.

AGE REQUIREMENT

  • The primary reserving guest must be at least 21 years of age.

CHECK-IN / CHECK-OUT

  • Check-in: after 1:00 PM. Check-out: by 12:00 PM noon.
  • Early check-in: pro-rata hourly fee based on nightly rate.
  • Late check-out: additional full night charged at the applicable nightly rate.

ELECTRICITY

  • A $50.00/month electricity allowance is included. All usage beyond this amount is billed to Guest.
  • Guest authorizes the Campground to charge any overage immediately to the payment method on file upon receipt of the bill, with or without advance notice.

HUNTING

  • Hunting in any form is strictly prohibited. Violations will result in immediate eviction and may involve local law enforcement.

SITE INTEGRITY

  • Physical alterations to any campsite or area of the premises are strictly prohibited, including hard piping, decks, porches, built steps, or any other modification.
  • All sites must be maintained in their original condition.

SNOW & ICE

  • Main roads will be plowed by management. Guests are solely responsible for clearing snow and ice within their individual campsite.

RECREATIONAL RESPONSIBILITY

  • Use of all recreational facilities — including hiking trails and playgrounds — is entirely at Guest’s own risk.

EARLY DEPARTURE

  • No refunds will be issued for early departure from a weekly or monthly stay.
  • Management reserves the right to retroactively charge the applicable daily rate for days actually stayed.

RV PARKING ASSISTANCE

  • If staff assist with parking guidance, Guest retains full responsibility for safe operation and placement of their vehicle. Any resulting damage or incident is solely Guest’s responsibility.

DRIVABILITY REQUIREMENT

  • All RVs and campers must be capable of being driven or towed by the Guest within 24 hours of notice.
  • Commercial driver drop-offs are not accepted.
  • Inability to remove the vehicle independently will result in immediate required departure.

MANAGEMENT AUTHORITY

  • Management reserves the right to require any Guest to vacate the premises at any time, for any reason. Such decisions are final and non-negotiable.

PAYMENTS & OUTSTANDING DUES

  • Full payment is due prior to check-in or by any earlier deadline specified by management.
  • Guest authorizes the Campground to charge the payment method on file for any unpaid balance, including taxes and fees.
  • All billing is rendered in advance of the coming week or month. Management may auto-bill on due dates and may auto-bill for outstanding utility charges.
  • Delinquent payment requires immediate vacation of the premises. Outstanding fees unpaid within 48 hours will result in immediate expulsion.
  • A valid payment method must remain on file for all stays exceeding one week. Failure to maintain one constitutes grounds for eviction.
  • Late payments incur a $10.00/day late fee until the balance is settled.

VIOLATIONS & FINES

  • Low-severity violations: $100 first offense; $200 each subsequent offense.
  • High-severity violations (at management’s sole discretion): up to $500 per violation.
  • All fines must be paid within 48 hours. Non-payment results in immediate required vacation of the premises.

ASSIGNMENT & SUBLETTING

  • The license granted is personal to Guest and may not be assigned, transferred, or sublet in whole or in part.
  • Subletting via Airbnb, VRBO, or any similar platform is strictly prohibited.
  • Violations may result in immediate termination and legal action.

CAMPSITE CLEANLINESS

  • Guest must maintain a clean, orderly campsite throughout their stay. Outdoor clothing racks are prohibited.
  • Upon departure, the site must be returned in a clean condition comparable to arrival. All waste must be placed in designated dumpsters.
  • Failure to meet cleanliness standards will result in a cleaning fee charged to the payment method on file.
  • All damage caused by Guest, minors, visitors, or pets must be reported promptly. Unreported damage will be assessed and charged after management inspection.

FIREARMS & EXPLOSIVES

  • Strictly prohibited anywhere on the premises: firearms, air rifles, bows and arrows, knives, fireworks, paintball guns, and explosives.
  • Violations will result in immediate eviction and may involve local law enforcement.

RV AGE RESTRICTION

  • For stays exceeding one month, RVs and trailers must be manufactured in 2010 or later.
  • Exceptions may be granted at management’s sole discretion based on vehicle condition.
  • Violations may result in eviction without refund.

NO WAIVER

  • Failure by management to enforce any provision of these Terms & Conditions does not constitute a waiver of that provision or any rights hereunder.

AMENDMENTS

  • These Terms & Conditions may be amended at any time at management’s discretion. Continued use of the campground constitutes acceptance of any revised terms.

EVICTION

  • Eviction for any reason results in permanent prohibition from returning to or re-entering the premises.

CANCELLATION POLICY

  • No refunds for weather, natural conditions, or unforeseen circumstances including COVID-19, except as outlined below.
  • In the event of a government-mandated lockdown or travel ban preventing travel, management will work with Guest toward a credit, reschedule, or other resolution at management’s discretion.
Campsites:

14+ days prior to arrival: Full refund less a $25.00 cancellation fee, or Guest may elect a full camp credit.

7–13 days prior to arrival: Camp credit equal to 50% of reservation value; no cash refund.

Less than 7 days prior to arrival: Reservation fully forfeited; no refund or credit issued.


REFUND POLICY

  • No refunds for weather, early departure, acts of nature, eviction, or circumstances beyond the Campground’s control.
  • All refunds are issued to the original payment method only. No exceptions.
  • Guest may elect to receive a camp credit in lieu of a refund, valid for one (1) year from the date of issuance.
  • Refunds are processed within 7–10 business days, subject to Guest’s financial institution.

CHANGE POLICY

  • Outside cancellation window (14+ days prior to arrival): First change is free; each subsequent change incurs a $15.00 service fee.
  • Inside cancellation window: No changes to reservation dates permitted.
  • A “change” includes any adjustment to dates or site type.

NO-SHOW POLICY

  • Reservations are held until 12:00 PM noon on the day following the scheduled arrival date.
  • After this time, the reservation is treated as a no-show and all funds are forfeited.

NATURAL DISASTER CLAUSE

This policy may be amended if either of the following occur:

  • A severe weather warning (blizzard, hurricane, or major storm) is issued for the campground area or Guest’s area of residence within 48 hours of the reservation start date.
  • A mandatory evacuation is declared causing a prolonged closure of the campground.
